1. Introduction

These Terms of Service ("Terms") govern your use of the DigiMaster Cyprus website and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

Please read these Terms carefully before using our Services. If you have any questions about these Terms, please contact us through our website.

2. Changes to Terms

We may modify these Terms at any time, at our sole discretion. If we do so, we will notify you by updating the "Last Updated" date at the top of these Terms. Your continued use of the Services after we make changes is deemed to be acceptance of those changes. If you do not agree to any changes to these Terms, you must stop using the Services.

3. Eligibility

You must be at least 16 years old to use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement. If you are under 18 years old but at least 16 years old, you represent and warrant that you have your parent's or legal guardian's permission to use the Services and that they have read and agree to these Terms on your behalf.

4. Account Registration and Security

To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We cannot and will not be liable for any loss or damage arising from your failure to protect your account credentials.

5. Course Registration and Payments

When you register for one of our courses, you agree to provide accurate and complete information about yourself and to update this information as necessary. You agree to pay all fees and charges associated with the course at the time of registration or in accordance with the payment plan you select.

All course fees are non-refundable except as expressly provided in our Refund Policy, which is incorporated into these Terms by reference. We reserve the right to change our course fees at any time, but changes will not affect courses for which you have already paid.

6. Refund Policy

If you cancel your course registration at least 14 days before the course start date, you will receive a full refund of the course fee, minus a 10% administrative fee. If you cancel less than 14 days before the course start date but before the first day of the course, you will receive a 50% refund. No refunds will be issued after the course has started.

For installment payment plans, the refund policy applies to the total course fee, not individual installments. If you have made partial payments and are eligible for a refund, the refund amount will be calculated based on the total course fee and the applicable refund percentage.

Refunds will be processed using the original payment method and may take up to 30 days to process.

7. Course Rescheduling and Cancellation

We reserve the right to reschedule or cancel a course due to low enrollment, instructor unavailability, or other circumstances beyond our control. If we reschedule a course, we will notify you as soon as possible and give you the option to attend the rescheduled course or receive a full refund.

If we cancel a course, you will receive a full refund of the course fee. We are not responsible for any other expenses you may incur as a result of the course rescheduling or cancellation, such as travel or accommodation expenses.

8. Intellectual Property Rights

All content, materials, and resources provided as part of our courses and Services, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, are the property of DigiMaster Cyprus or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the course materials solely for your personal, non-commercial, educational purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, sell, or otherwise exploit our course materials without our prior written consent.

9. User Conduct

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

  • In any way that violates any applicable law or regulation
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • To impersonate or attempt to impersonate DigiMaster Cyprus, a DigiMaster Cyprus employee, another user, or any other person or entity
  • To introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services
  • To attack the Services via a denial-of-service attack or a distributed denial-of-service attack
  • To otherwise attempt to interfere with the proper working of the Services

10. Privacy

Our Privacy Policy, which is incorporated into these Terms by reference, describes how we collect, use, and disclose information about you.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DIGIMASTER CYPRUS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

13. Indemnification

You agree to defend, indemnify, and hold harmless DigiMaster Cyprus, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

14. Governing Law and Jurisdiction

These Terms and your use of the Services are governed by and construed in accordance with the laws of the Republic of Cyprus, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of the Republic of Cyprus, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

16. Entire Agreement

The Terms, our Privacy Policy, and any other agreements expressly incorporated by reference herein, constitute the sole and entire agreement between you and DigiMaster Cyprus regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

17. Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
